Constitutional Provisions:

The office of the Governor is governed by Part VI of the Constitution of India.

      • Article 153: Provides for a Governor for each State. The same person may be appointed Governor of two or more States.
      • Article 155: The Governor is appointed by the President by warrant under his or her hand and seal.
      • Article 156: The Governor holds office during the pleasure of the President and ordinarily has a five-year term, subject to the constitutional provision.
      • Article 157: Specifies the qualifications for appointment as Governor. A person must be a citizen of India and at least 35 years of age.
      • Article 158: Specifies the conditions of the Governor's office, including restrictions on holding other offices of profit.
      • Article 163: Provides for a Council of Ministers headed by the Chief Minister to aid and advise the Governor, except where the Constitution requires the Governor to exercise discretion.
      • Article 200: Deals with the Governor's options when a Bill passed by the State Legislature is presented for assent.

Role and Powers of the Governor:

The Governor is the constitutional head of a State and acts as a link between the Union and State governments. The Governor appoints the Chief Minister and, on the Chief Minister's advice, other ministers; summons and prorogues the State Legislature; and gives assent to Bills as provided under the Constitution. The Governor also performs certain judicial, legislative and discretionary functions within constitutional limits.

Conclusion:

The appointment of Governors in six states is an important development in India's constitutional administration. While the Governor's office safeguards constitutional governance, its functioning must remain consistent with democratic accountability, cooperative federalism and the principles of the Constitution.
